Scope
The following Terms and Conditions apply to all orders placed via our online shop on www.3p.net.au, as well as any viewing and downloading of images. If you use this website, you agree to these Terms and Conditions.
Contractual partner, formation of contract
The purchase contract is concluded with 3P Photography.
The display of products within the online shop constitutes a binding offer on our part to enter into a contract vis-а-vis the items. Products may be placed in the basket without obligation and entries can be amended at any time prior to submitting a binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the products contained in your basket.
Once you have sent an order, a confirmation e-mail will be received.
Previous orders cannot be accessed via the internet for security reasons.
Contract amendments
The language available for concluding the contract is English.
3P reserves the right to amend the Terms and Conditions at any time. Amendments will be effective immediately upon notification on this website. The continued use of the website following such notification will represent an agreement to be bound by the Terms and Conditions, as amended.
Ordering conditions and entering contract
The Professional School Photography Association and Industry in Australia operates on a pre-order, pre-pay basis. 3P Photography collects payment and orders before ‘Photo Day’.
Customers must be at least 18 years old to place any orders with the website. By placing an order, agreeing to the Terms and Conditions, and creating a contract with 3P Photography, you confirm that you are at least 18 years of age. If 3P Photography suffers any loss, financial or otherwise, because you are less than 18 and you placed an order, 3P Photography may, in its discretion, pursue compensation for such a loss from your adult parent(s) or legal guardian(s) because you attempted to engage in a transaction with 3P Photography.
A handling and shipping fee may be applied to orders received after photo day.
Delivery conditions
Products are prepared and printed in a batch process, and all pre-orders are delivered to the school approximately 7 weeks following Photo Day, to be distributed by the school.
For schools that have chosen to have no photo handling on site, products are still prepared and printed in a batch process, and all pre-orders are distributed individually via Australia Post approximately 7 weeks following Photo Day, in these circumstances a Handling/Shipping Fee is applied to all orders.
If your order is for photography products, whereby the closing date for pre-orders has passed, then your order is classified as a re-order, late order, or special order.
Orders in these categories will be delivered to the address specified on your order, via Australia Post. Delivery costs are in addition to the product prices displayed.
Large / multiple items are delivered to the school / pick up from 3P are subject to additional shipping fees.
Photo orders are distributed in a hard cardboard folder instead of plastic to reduce the environmental impact. 3P is proud to make a difference to reduce the carbon footprint of the production and distribution of products and 3P thanks the school communities for supporting and working towards creating a more sustainable and green industry.
For storage and privacy reasons, 3P maintains a record of your order for 6 months. Queries after this time cannot be addressed.
Pricing and Products
Prices shown on this website are in Australian dollars (AUD) and include GST where applicable. Prices are subject to change.
Images of products are for illustrative purposes only and may vary from the products depicted or described. Print sizes are approximate.
Annual class photos, as well as any student images cannot be viewed prior to ordering. Digital copies of your order will be available after delivery to the school.
Only student individual photos can be obtained in digital format, besides photo prints.
Where an amount equivalent to a single photo has been paid without indication of selection, the default order is for a Class Group photo print.
A handling and shipping fee may be applied to orders received after photo day.
School Balls and Events
All Senior/High School Ball images are supplied with a complimentary upgrade to a high-end Vogue Edit from 3P Photography.
For all other events, images are featured in their original state. Once an image has been ordered, it will then be edited (cropping and colour correction as required).
Please allow up to 3 weeks for delivery of both printed and digital images.
Additional fees apply to urgent orders.
If a password has been added to an online album, 3P Photography are not permitted to give this out. This can be obtained from the event organiser only; 3P apologises for any inconvenience this may cause.
Images will remain online for 6 months. After this time, they can still be accessed, a $100 upload fee will apply which will credit against any print orders.
Editing
3P Photography does not photoshop any images. 3P Photography encourages children to embrace the way they are and be proud of it. Body image issues are unfortunately all too common these days.
Any exception to this must have written permission granted by both the student’s adult parent(s) or legal guardian(s) and the school. This will incur an Editing Fee of $25.00.
Absentees
3P Photography offers all absentees a quality catch up shoot in our Malaga studio. Bookings are required and can be made by contacting our office. 3P Photography does not guarantee for absent students to be included in any class photos.
If for any reason you are unable to attend our studio for a catch up shoot, a refund will apply which will be issued as a credit note.
Retention of title
The products shall remain the property of 3P Photography until full payment is made.
Order change or cancellation
3P Photography advises to choose carefully and only place an order when you are completely ready. Once an order has been submitted, there can be no change or cancellation made to the order placed.

Payment
The following payment methods are available in our online shop. Unsuccessful payments will result in no order being placed.
Credit Card
With the submission of the order, you are sending 3P Photography your credit card details at the same time.
After your identification as the legal cardholder, directly after the order, 3P will ask your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and charged to your card.
3P Photography cannot take any responsibility for missing cash or credit card security when a Paper Order Form envelope is received unsealed.
Damage during delivery or missing products
If the products are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify 3P Photography without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help 3P Photography to press their own claims against the carrier or transport insurer.
In relation to any missing or damaged products it is your responsibility to contact 3P Photography within 30 days of delivery (approx 6-8 weeks after Photo Day). 3P Photography maintains accurate dispatch records and will be able to determine if a credit or replacement is due to you.
All queries must be submitted in writing and forwarded to 3P Photography, either via the online Query Form or via email. For storage and privacy reasons, 3P maintains a record of your order for 6 months. Queries after this time cannot be addressed.
Return Policy
3P Photography offers a 100% satisfaction guarantee. If you are not fully satisfied with your photographs, simply return them to 3P Photography within 14 days of receiving your photos. All goods being returned to 3P Photography are to be at the customer’s expense and must be posted to Unit 7, 30 Enterprise Crescent, Malaga WA 6090.
Where a refund applies, we will issue a credit note or it will be processed via credit card or bank transfer. Any credit note or refund issued will only be finalised once 3P has received the returned product.
Please note Digital Download purchases are non-refundable. Photo Packs that include Digital Downloads are also not eligible for a full refund.
Should you need to amend or cancel your order, you must get in contact with the 3P Customer Service team within 7 days after your last photo day. If you contact after 7 days we may be unable to modify or cancel your order.
Online orders all come with an emailed tax invoice, please ensure you review and retain this invoice as proof of purchase.
Please note 3P Photography does not accept responsibility for mail that Australia Post loses or damages. If this occurs please contact Australia Post directly.

Warranty and guarantees
3P Photography has a legal duty to supply products that have been ordered.
Statutory warranty rights of Australia apply for customers.
Information on any additional guarantees and their precise conditions that may apply can be found next to the product and on specific information pages in the shop, if applicable.

When you exercise your warranty rights and 3P deems it necessary to receive the products back to examine your complaint, you must send back the products at your cost to the address given above. 3P is committed to respond to any complaint immediately, but no later than within 2 weeks of its submission.
Customer service is available for queries, complaints and claims on weekdays between 8.00am to 3.00pm via phone or email at hello@3p.net.au or by submitting the Online Query Form.

Liability
3P cannot accept liability for any failure to comply with these Terms and Conditions where such failure is due to circumstance beyond our reasonable control.
If 3P waives any rights available under these Terms and Conditions on one occasion, this does not mean that those rights will automatically be waived on any other occasion.
If any of these Terms and Conditions are held to be invalid, unenforceable, or illegal for any reason, the remaining Terms and Conditions shall nevertheless continue in full force.
Privacy Policy
3P Photography is serious about protecting your privacy. 3P values and respects the professional relationships with clients, staff, and other individuals, and understands the desire for privacy.
In handling your personal information, 3P is committed to supporting the Privacy Act 1988 (Privacy Act) and the 13 Australian Privacy Principles in the Privacy Act (as amended). This policy sets out how 3P Photography collects, stores, uses, discloses, and otherwise handles your personal information. This policy may be updated from time to time.
Group Photos
Group photos are taken as part of Photo Day and are available for purchase by the school community. If for any reason your child cannot be included in a group photo, please ensure you have notified your school administration prior to Photo Day.
What personal information does 3P Photography collect and why?
During the provision of its services and/or products, 3P Photography may collect your personal information.
The following is personal information 3P Photography collects:
Contact and identification information such as your name, address, telephone/mobile numbers, and email address; credit card and other banking information for the purpose of facilitating payment to 3P Photography for services and/or products provided; images of you contained in photographic materials in some circumstances 3P Photography may also hold other personal information provided by you. Privacy law requires 3P to collect personal information about you only if it is reasonable and practical to do so.
How does 3P Photography collect personal information?
Generally, 3P Photography collects your personal information directly from you, through the completion of a manual or online form, such as the Photo Day order envelope, an interaction or exchange in person, such as through a face-to-face meeting, or by way of telephone, email, post or using of the 3P Photography website. Alternatively, 3P Photography collects your personal information from other sources such as from your school administrator, such as your childs’ school name, class name, year group, and legal name. Generally, 3P Photography will only collect your personal information from sources other than you if it is unreasonable or impracticable to collect your personal information from you.
Why does 3P Photography need your personal information?
3P Photography collects, holds, and uses your personal information where it is reasonably necessary for the purposes of providing to you personalised photography services and photography products, including processing your orders and dealing with requests, enquiries or complaints and other customer care related activities; accounting, billing, and other internal administrative and business management purposes; and carrying out market and product analysis. 3P Photography may also use your personal information, including your image, quotes, or other information for inclusion with our marketing materials, where you have consented to such use.
At times 3P Photography may wish to notify you about new and upcoming products. This will be in the form of an email sent to orders that are placed through 3P’s various ordering systems. If you do not wish to receive such emails, simply reply STOP to the email and you will be removed from the database. Also, 3P Photography may use your personal information for purposes related to the above purposes and for which you would reasonably expect 3P Photography to do so in the circumstances, or where you have consented, or the use is otherwise in accordance with law.
Where personal information is used or disclosed, 3P Photography takes steps reasonable in the circumstances to ensure it is relevant to the purpose for which it is to be used or disclosed. You are under no obligation to provide your personal information to 3P Photography. However, without certain information from you, 3P Photography may not be able to provide its services and/or products to you.
Does 3P Photography disclose/sell your personal information?
3P Photography will not disclose nor sell your personal information to any third party for any reason, except if required by law. The 3P Photography website contains links to, and hosts password protected content on other websites. 3P Photography is not responsible for the privacy practices or the content of such websites that are linked.
Security of your Personal Information
3P Photography takes steps reasonable in the circumstances to ensure that the personal information it holds is protected from misuse, interference, and loss and from unauthorised access, modification, or disclosure. 3P Photography holds personal information in both hard copy and electronic forms in secure databases on secure premises, accessible only by authorised staff. Online credit card details are processed and secured by a Third Party. Please see PayPal AUS.
3P Photography will destroy personal information in circumstances where it is no longer required, unless 3P Photography is otherwise required or authorised by law to retain the information.
When purchasing from 3P Photography, your financial details are passed through a secure server and is of the current industry standards. Whilst 3P strives to protect such information, 3P does not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information which you transmit to 3P is transmitted at your own risk. Nevertheless, once 3P receives your transmission, 3P will take reasonable steps to preserve the security of such information.
Data Breach Compliance
In the event of a Data Breach, leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, data collected by yourself or the school, 3P Photography will take the following actions: will be treated seriously; will be dealt with promptly.

COVID-19
Mindful of the on-going situation, 3P Photography is implementing procedures for Photography services during the COVID-19 pandemic that are subject to change. 3P’s priority has been, and will continue to be, to ensure the safety and wellbeing of the school communities.
3P is implementing social distancing rules with zero contact on Photo Days during COVID-19 measures and in compliance with the guidelines outlined by the relevant Governmental Departments and Health Authorities.
Please note, on Photo Day, 3P staff cannot fix student’s collars or hair. Students are responsible for their own grooming.
There is no denying that COVID-19 is affecting our day-to-day activity in unprecedented ways. 3P is taking active approach to ensure the safety of all involved and to maintain a high degree of professionalism and consistency during these changing times and 3P Photography will adapt accordingly.
