Scope
These Terms and Conditions apply to all orders placed through our online shop at www.3p.net.au and any image viewing or downloading. By using this website, you agree to these terms.
Contractual partner, formation of contract
The purchase contract is established with 3P Photography.
The display of products in our online shop represents a binding offer from us to enter into a contract regarding those items. You can add products to your basket without obligation, and you can make changes at any time before placing your order using the provided correction tools.
The contract is formed when you click the order button, indicating your acceptance of our offer for the products in your basket.
After placing your order, you will receive a confirmation email, which also serves as your Tax Invoice. For security reasons, previous orders cannot be accessed online.
Contract amendments
The contract will be concluded in English. 3P reserves the right to change the Terms and Conditions at any time. Changes will take effect immediately upon notification on this website.
Your continued use of the site after such notification indicates your agreement to the updated Terms and Conditions.
Ordering conditions and entering contract
The Professional School Photography Association and Industry in Australia operates on a pre-order, pre-pay basis. 3P Photography collects payment and orders before ‘Photo Day.’
You must be at least 18 years old to place an order on the website. By placing an order and agreeing to the Terms and Conditions, you confirm that you are at least 18.
If 3P Photography incurs any loss due to your being under 18 when placing an order, we may seek compensation from your parent(s) or legal guardian(s) for engaging in a transaction with us.
An Archive Fee will be applied to all orders received after photo delivery to the school.
Delivery conditions
Products are prepared and printed in batches, with all pre-orders delivered to the school approximately 6-8 weeks after Photo Day for distribution.
If you place an order for photography products after the pre-order deadline, it will be classified as an Archive Order and be sent to the address specified in your order via Australia Post, with delivery costs additional to the product prices displayed.
Large or multiple items typically delivered to the school or picked up from 3P may incur extra shipping fees if ordered after delivery.
To reduce environmental impact, photo orders are packaged in hard cardboard folders instead of plastic. 3P is committed to minimizing our carbon footprint in production and distribution, and we appreciate the support of school communities in creating a more sustainable industry.
For storage and privacy reasons, we keep a record of your order for six months. Unfortunately, we cannot address queries after this period.
Pricing and Products
Prices on this website are in Australian dollars (AUD) and include GST where applicable. Prices are subject to change.
Product images are for illustrative purposes only and may differ from the actual products. Print sizes are approximate. Previews are not available before ordering. Any digital downloads included in your order will be available via our website after photo delivery.
If payment is made for a single photo without a selection indicated, the default order will be for a Class Group photo print.
An Archive Fee will apply to all orders received after photo delivery.
School Balls and Events
All Senior/High School Ball images come with a complimentary upgrade to a high-end Vogue Edit from 3P Photography. For other events, images are provided in their original state. Once an image is ordered, it will be edited (including cropping and color correction as needed).
Please allow up to 3 weeks for delivery of both printed and digital images.
Additional fees apply for urgent orders.
If a password has been set for an online album, this can only be obtained from the event organiser; 3P apologises for any inconvenience this may cause.
Editing
3P Photography does not use Photoshop on any images. We encourage children to embrace their natural selves and take pride in who they are, especially in light of common body image issues today.
Any exceptions to this policy require written permission from both the student’s parent(s) or legal guardian(s) and the school, and will incur an Editing Fee of $35.00.
Absentees
3P Photography offers quality catch-up shoots for all absentees at our Malaga studio. Bookings are required and can be made by contacting our office. Please note that we cannot guarantee that absent students will be included in class/group photos. If you are unable to attend the studio for a catch-up shoot, any applicable refund will be issued as a credit.
Retention of title
The products will remain the property of 3P Photography until full payment is received.
Order change or cancellation
3P Photography recommends that you choose carefully and place your order only when you are fully ready. Once an order has been submitted, should you need to cancel or amend any details you have 7 days to notify us in writing, after this time we are unable to make changes.

Payment
The following payment methods are available in our online shop. Please note that unsuccessful payments will result in no order being placed.
Credit Card: By submitting your order, you provide 3P Photography with your credit card details. After verifying your identity as the legal cardholder, 3P will request your credit card company to initiate the payment transaction, which is automatically processed and charged to your card.
PayPal: Once you place your order, you will be redirected to PayPal’s online payment gateway. To pay via PayPal, you must have an account or create one, log in with your credentials, and confirm the payment instructions to 3P Photography. The payment transaction will be initiated after you submit your order. Additional information will be provided during the ordering process.
Cash: 3P Photography cannot be held responsible for any missing cash if a Paper Order Form envelope is received unsealed.
Missing products
For any missing products, you must contact 3P Photography within 30 days of delivery (approximately 6-8 weeks after Photo Day). We keep accurate dispatch records to determine if a credit or replacement is warranted.
All queries should be submitted in writing through the online Query Form or via email.

Damaged products
If your products are delivered with visible damage, please report the issue to the carrier and notify 3P Photography immediately. While failing to report the damage does not affect your legal rights, including warranty rights, it helps us pursue our claims against the carrier or transport insurer.
For any damaged products, you must contact 3P Photography within 14 days of delivery (approximately 6-8 weeks after Photo Day). We keep accurate dispatch records to determine if a credit or replacement is warranted.
All queries should be submitted in writing through the online Query Form or via email.

Return Policy
3P Photography offers a 100% satisfaction guarantee. If you are not completely satisfied with your photographs, you can return them within 14 days of receiving them.
Please note that all returns are at the customer’s expense and should be sent to Unit 7, 30 Enterprise Crescent, Malaga WA 6090.
Refunds will be processed as a credit or via credit card/bank transfer, but will only be finalised once we receive the returned product.
Please be aware that Digital Download purchases are non-refundable, and Photo Packs that include Digital Downloads are also ineligible for a full refund.
All online orders include an emailed tax invoice. Please review and keep this invoice as proof of purchase.
3P Photography does not accept responsibility for items lost or damaged by Australia Post. If this happens, please reach out to Australia Post directly.

Warranty and guarantees
3P Photography has a legal obligation to supply the products you have ordered. Statutory warranty rights in Australia apply to customers.
Information about any additional guarantees and their specific conditions can be found next to the product and on relevant information pages in the shop, if applicable.

If you exercise your warranty rights and 3P needs to inspect the products, you must return them at your own cost to the address above. We are committed to responding to any complaint promptly, but no later than 2 weeks from the date of submission.

Liability
3P cannot be held liable for any failure to comply with these Terms and Conditions if such failure is due to circumstances beyond our reasonable control.
If 3P waives any rights under these Terms and Conditions on one occasion, it does not mean those rights are automatically waived in the future.
If any of these Terms and Conditions are found to be invalid, unenforceable, or illegal for any reason, the remaining Terms and Conditions will continue to remain in full effect.
Privacy Policy
3P Photography is committed to protecting your privacy. We value and respect our professional relationships with clients, staff, and others, and understand the importance of privacy.
In managing your personal information, 3P adheres to the Privacy Act 1988 and the 13 Australian Privacy Principles. This policy outlines how we collect, store, use, disclose, and handle your personal information. Please note that this policy may be updated from time to time.
Group photos: are taken on Photo Day and are available for purchase by the school community. If your child cannot be included in a group photo for any reason, please notify your school administration before Photo Day.
What personal information does 3P Photography collect and why?
In the course of providing our services and products, 3P Photography may collect your personal information for various purposes.The following personal information is collected by 3P Photography:
– Contact and identification information: Your name, address, telephone/mobile numbers, and email address.
– Payment information: Credit card and other banking details for processing payments for our services and products.
– Photographic images: Images of you included in our photographic materials.
– Additional information: In some cases, we may also hold other personal information you provide.

How does 3P Photography collect personal information?

Additionally, we may collect your personal information from other sources, such as your school administrator, which can include your child’s school name, class name, year group, and legal name. We will only collect personal information from sources other than you when it is unreasonable or impractical to do so.
Why does 3P Photography need your personal information?
3P Photography collects, holds, and uses your personal information when it is reasonably necessary for:
– Providing personalized photography services and products, including processing your orders and addressing requests, inquiries, or complaints.
– Accounting, billing, and other internal administrative and business management activities.
– Conducting market and product analysis.
We may also use your personal information, including your image or quotes, in our marketing materials if you have given your consent for such use.
At times, 3P Photography may want to notify you about new and upcoming products through emails sent to those who have placed orders. If you prefer not to receive these emails, simply reply “STOP,” and you will be removed from our mailing list. Additionally, we may use your personal information for related purposes that you would reasonably expect or where you have consented, in accordance with the law.
When using or disclosing personal information, 3P Photography takes reasonable steps to ensure it is relevant to the purpose for which it is used or disclosed. While you are not obligated to provide your personal information, please note that without certain information, we may not be able to offer our services and products to you.
Does 3P Photography disclose/sell your personal information?
3P Photography will not disclose or sell your personal information to any third party for any reason, except as required by law. Our website may contain links to other sites and host password-protected content. However, 3P Photography is not responsible for the privacy practices or content of those linked websites.
Security of Your Personal Information
3P Photography takes reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. We store personal information in both hard copy and electronic forms within secure databases on secure premises, accessible only by authorized staff.
Online credit card details are processed and secured by third parties, specifically PayPal AUS and CommBank Simplify.
3P Photography will destroy personal information when it is no longer required, unless we are legally obligated to retain it.
When you purchase from 3P Photography, your financial details are transmitted through a secure server in accordance with current industry standards. While we strive to protect this information, we cannot guarantee its security during transmission. Any information you send to us is at your own risk. However, once we receive your information, we will take reasonable steps to ensure its security.
Data Breach Compliance
In the event of a data breach resulting in accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access to data collected by you or the school, 3P Photography will treat the situation seriously and address it promptly.

COVID-19 Update
In light of the ongoing COVID-19 situation, 3P Photography is implementing flexible procedures for our photography services that may change as necessary. Our top priority remains the safety and well-being of the school communities we serve.
To ensure continued safety, we are still incorporating social distancing measures and a zero-contact approach on Photo Days, following the guidelines provided by relevant governmental and health authorities.
Please remember that on Photo Day, 3P staff will not be able to adjust students’ collars or hair; students are responsible for their own grooming.
