TERMS AND CONDITIONS
The following T&Cs apply to all orders placed via our online shop on www.3p.net.au, as well as any viewing and downloading of images. If you use this website, you agree to these Terms and Conditions.
2. Contractual partner, formation of contract
The purchase contract is concluded with 3P Photography.
The display of products within the online shop constitutes a binding offer on our part to enter into a contract vis-à-vis the items. You may place our products in your basket without obligation and amend your entries at any time prior to submitting a binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in your basket. Once you have sent your order you will immediately receive a confirmation via e-mail.
Your previous orders cannot be accessed via the internet for security reasons.
3. Contract amendments
The language available for concluding the contract is English.
3P reserve the right to amend the Terms and Conditions from time to time. Amendments will be effective immediately upon notification on this website. Your continued use of the website following such notification will represent an agreement by you to be bound by the terms and conditions as amended.
4. Ordering conditions and entering contract
You must be at least 18 years old to place any orders with the website. By placing an order, agreeing to the Terms and Conditions, and creating a contract with us, you confirm that you are at least 18 years of age. If 3P Photography suffers any loss, financial or otherwise, because you are less than 18 and you placed an order with us, 3P Photography may, in its discretion, pursue compensation for such a loss from your adult parent(s) or legal guardian(s) because you attempted to engage in a transaction with 3P Photography.
5. Delivery conditions
Delivery costs are added to the product prices as displayed. Delivery charges are explained within individual product offers.
We only dispatch goods en route; pick up by the customer is not possible.
The Professional School Photography Association and Industry in Australia operates on a pre-order, pre-pay basis. 3P Photography collects payment and orders before ‘Photo Day’, products are then prepared and printed in a batch process, and all pre-orders are then delivered to the school to be distributed by the school. Pre-orders will be delivered to the school approximately 7 weeks following Photo Day.
If your order is for photography products whereby the closing date for pre-orders has passed, then your order is classified as a re-order, late order or special order.
Orders in these categories will be delivered to the delivery address defined by you in your order. Orders will be dispatched to your delivery address via Australia Post and received within 4 weeks of placing your order.
6. Pricing and Products
Prices shown on this website are in Australian dollars (AUD) and include GST if applicable. Prices are subject to change.
Images of products are for illustrative purposes only and may vary from the products depicted or described. Print sizes are approximate.
Annual Class Photos, as well as any Student images cannot be viewed prior to ordering. Digital copies of your Order will be available after Deliver to the School.
Only Student individual Photos can be obtained in digital format, besides Photo Prints.
7. School Balls and Events
Unless specified, images found here are in their original state. Once an image has been ordered, it will then be edited (cropping and colour correction as required)
Please allow up to 21 days for delivery of both Printed and Email images.
Additional fee’s will apply for rush orders.
If a password has been added to an album, we are not permitted to give this out. This can be obtained from the event organiser only. We do apologies for any inconvenience.
Images will remain on the website for up to 12 months. After this time they can be accessed from archive and a $100 upload fee applies, which is redeemable for prints/emails from that album. High Resolution Albums will remain for 6 months. After this time, they must be ordered as per usual.
Vogue Images – Photos will receive an edit to feel like a “Vogue High Fashion Shoot”. Remove blemishes and soften skin tone.
Black & White Images – Photos will receive an edit to transform them into classic elegance Black and White.
3P Photography does not photoshop any images. An exception must be permitted by the Guardian and the School in Writting with an Editing Fee of $25.00.
3P however encourages children to embrace the way they are and be proud of it.
Body image issues are unfortunately all too common these days.
3P Photography offers a Studio Quality Shoot in our Midland Office for all Absentees. Boookings for individual and Sibling Photos are available withing 2 weeks after your School Photo Days. 3P Photography can not guarantee for absent Students to be included in any Class Photos.
10. Retention of title
The goods shall remain our property until full payment is made.
11. Order change or cancellation
3P Photography strongly urges you to please choose carefully and only place your order when you are completely ready. Once an order has been submitted, there can be no change or cancellation made to the order placed.
The following payment methods are basically available in our online shop. Unsuccessful payments will result in no order being placed.
With the submission of the order, you are sending us your credit card details at the same time. After your identification as the legal cardholder, directly after the order, we will ask your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and charged to your card.
After placement of the order, you will be forwarded to PayPal’s online website. To pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your access data and confirm the payment instructions to us. After submitting your order in the shop we instruct PayPal to initiate the payment transaction. You will receive additional information during the ordering process.
3P cannot take any responsibility for missing cash or credit card security when a Paper Order Form envelope is received unsealed.
13. Damage during delivery or missing goods
If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to press our own claims against the carrier or transport insurer.
If there is a product missing or is damaged in your order, it is your responsibility to contact 3P Photography within 14 days of delivery. 3P maintains accurate dispatch records and will be able to determine if a credit or replacement is due to you.
All queries must be in writing and forwarded to 3P Photography. Please fill out the Query Form online or contact us via Email. For storage and privacy reasons, we maintain a record of your order for 6 months. Queries after this time cannot be addressed.
14. Return Policy
3P Photography offers a 100% satisfaction guarantee. If you are not fully satisfied with your photographs simply return them to the 3P office within 14 days of receipt and you will receive a full refund.
The return period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To meet the return deadline, it is sufficient for you to send your communication concerning your exercise of the right of return before the return period has expired.

All goods being returned to 3P Photography are to be at the customer’s expense. There will be no return on Digital copies.
We will make the reimbursement using the same means of payment as you used for the initial transaction, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back in our Office.

15. Warranty and guarantees
We are under a legal duty to supply products that are in conformity with this contract.
For consumers, statutory warranty rights governed by the law of the country where the consumer has his habitual residence apply.
Information on any additional guarantees and their precise conditions that may apply can be found next to the product and on specific information pages in the shop, if applicable.

When you exercise your warranty rights and we deem it necessary to receive the goods back in order to examine your complaint, you must send back the goods at your cost to the address given above. We are committed to respond to any complaint immediately, but no later than within 14 days of its submission.

We accept no liability for any failure to comply with these terms and conditions where such failure is due to circumstance beyond our reasonable control.
If we waive any rights available to us under these Terms and Conditions on one occasion, this does not mean that those rights will automatically be waived on any other occasion.
If any of these Terms and Conditions is held to be invalid, unenforceable or illegal for any reason, the remaining Terms and Conditions shall nevertheless continue in full force.
3P Photography is committed to supporting the ‘National Privacy Principles for the Fair Handling of Personal Information’ (HUhttp://www.privacy.gov.au/UH). 3P Photography respects your privacy and is committed to protecting it.
The personal information which we collect is needed for providing services to you, such as your name, address, telephone number or delivery address. Privacy law requires us to collect personal information about you only if it is reasonable and practical to do so.
3P Photography takes measures to ensure your personal information is protected from unauthorised access, loss, misuse, disclosure or alteration. We also take measures to destroy personal information when it is no longer required.
Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information which you transmit to us is transmitted at your own risk.
Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information.
When purchasing from 3P Photography, your financial details are passed through a secure server and is of the current industry standards.
